Customer Cancellation
Customers may cancel their subscriptions to prevent future renewals. Unless otherwise agreed in writing, cancellation takes effect at the end of the current paid subscription period.
Customer cancellation, early departure, non-use of services, or a decision to transfer to another provider does not entitle the customer to a refund, prorated reimbursement, rebate, or credit for amounts already paid, except as required by applicable law.
Annual subscriptions are purchased for a full twelve-month service period. Cancellation before that period ends stops the next renewal but does not create a right to reimbursement for the unused portion of the annual term. A customer’s request for an earlier shutdown or transfer does not change this policy.
Termination for Material Breach
Boulder River Media may suspend or terminate services if a customer materially breaches the applicable agreement. Any notice or opportunity to cure will be governed by that agreement and applicable law.
To the fullest extent permitted by applicable law, termination for the customer’s material breach does not entitle the customer to a refund, rebate, or credit of amounts previously paid. Termination does not eliminate payment obligations already incurred.
Nothing in this provision authorizes an unlawful penalty or limits any right or remedy that cannot legally be waived.
Termination by Boulder River Media for Convenience
Boulder River Media may terminate an ongoing service for business reasons unrelated to a customer’s breach by providing written notice identifying the effective termination date. No subscription renewals will be charged for periods beginning after that date.
If Boulder River Media terminates a paid service for its own convenience, any refund, prorated reimbursement, rebate, or credit beyond what applicable law requires will be determined by Boulder River Media on a case-by-case basis, in its discretion and consistent with applicable law.
In making that determination, Boulder River Media may consider the unused prepaid service period, work already performed, deliverables provided, and nonrecoverable costs incurred for the customer. This provision does not create a guaranteed refund entitlement beyond any entitlement required by law.
A voluntary refund or credit in one instance does not create a right to the same treatment in another instance.
Mandatory Legal Rights
These cancellation, refund, and termination provisions apply only to the extent permitted by applicable law. Nothing in these Terms excludes a refund or other remedy that applicable law requires.
